aikoo Terms of Service

These Terms of Service (hereinafter "Terms") define the conditions for using aikoo (hereinafter "the Service"). The Service is in development stage and features or specifications may change without notice. By using the Service, you are deemed to have agreed to these Terms.

1. Nature of Service

  1. The Service is provided as a beta version and is currently in development and improvement stage.
  2. We do not guarantee the continuity, stability, or completeness of the Service.
  3. We recommend that users back up important data themselves.
  4. Service content, features, and specifications may be changed, added, or removed without notice.

2. Definitions

  • "Service Use Agreement" refers to the agreement for using the Service concluded between aikoo and Users based on these Terms.
  • "Intellectual Property Rights" refers to all intellectual property rights including copyrights, patent rights, and trademark rights.
  • "Posted Data" refers to all data including text, images, videos, and other content that Users post or transmit on the Service.
  • "aikoo Site" refers to websites with domains "aikoo.me" and "zampaco.com" (including changes if domains or content are modified).
  • "Registered Users" refers to individuals or corporations who have completed membership registration for the Service.

3. Registration

  1. Prospective users may apply for registration by agreeing to comply with these Terms and providing required information ("Registration Information") through the method specified by aikoo.
  2. The Service uses AI-generated information. Prospective users understand that generated content may contain inaccuracies and apply for registration at their own risk.
  3. Users under 13 years of age may not use the Service. Users under 16 years of age require parental consent.
  4. We will determine registration approval based on our own criteria, and registration is completed upon approval.

4. Service Provision

  1. We make no warranties regarding the safety, accuracy, or usefulness of the Service.
  2. We may change, add, or discontinue supported devices, OS, and browsers without notice and bears no responsibility for resulting damages.

5. Changes to Registration Information

Registered Users must promptly update their registration information through the Operator's specified method when changes occur.

6. Notifications

We may send notifications via email for service operation, feature improvements, and promotional purposes. Users can opt out through unsubscribe settings if unwanted.

7. Login Information Management

Registered Users are responsible for managing their login information, and we bear no responsibility for damages caused by unauthorized use by third parties.

8. Prohibited Activities

Users must not engage in the following activities when using the Service:

  • Activities violating laws or these Terms
  • Activities infringing on others' rights or interests
  • Posting excessively violent, obscene, discriminatory content or content promoting illegal drugs
  • Activities disrupting service operations (unauthorized access, excessive system load, etc.)
  • Providing benefits to antisocial forces
  • Other activities deemed inappropriate by us

We may delete posted data and take measures such as account suspension or deletion without prior notice if it determines prohibited activities have occurred.

9. Service Suspension

We may suspend or interrupt the Service without prior notice to Users for reasons including system maintenance, natural disasters, or unforeseen circumstances.

10. Free Use and Future Paid Features

  1. The Service is currently free, but additional features may be offered for a fee in the future.
  2. Paid plan details, pricing, and payment methods will be separately determined and announced on the aikoo site upon introduction.

11. Indemnification

If Users cause damage to us through violation of these Terms or laws, Users shall compensate for such damages (including attorney fees).

12. Intellectual Property Rights

  1. All intellectual property rights related to the Service and aikoo site belong to us or its licensors.
  2. Users warrant that they have lawful rights to posted data and do not infringe on third-party rights.
  3. Users grant us a worldwide, non-exclusive, royalty-free license to use posted data (including reproduction, publication, adaptation, etc.) and agree not to exercise moral rights.

13. Usage Precautions

Please understand that this is a service used by an unspecified number of people and exercise caution when disclosing personal information.

14. Registration Cancellation

We may take measures such as account suspension or deletion without prior notice if Users violate these Terms.

15. Withdrawal and Data Handling

  1. Registered Users can immediately delete their accounts through the settings page.
  2. When an account is deleted, personally identifiable information will be removed. However, anonymized data may be retained for service improvement and statistical purposes.
  3. Users may optionally provide a reason for deletion (used for service improvement purposes).
  4. Deletion is executed immediately and cannot be undone.

16. Service Changes and Termination

We may change the Service content/specifications or terminate provision for business reasons. Reasonable advance notice will be given for significant changes or termination.

17. Disclaimer and Limitation of Liability

  1. We make no warranties regarding the Service's fitness for specific purposes, accuracy, completeness, or continuity.
  2. Even if we are liable, compensation is limited to the amount paid by the User in the past month (0 yen if no payment).
  3. We bear no responsibility for the accuracy of AI-generated content or transaction results.

18. Disputes Between Users

Communications, transactions, and disputes between Users shall be resolved between the parties, and we bear no responsibility.

19. Confidentiality

Users must not disclose non-public information disclosed as confidential by us to third parties.

20. Handling of User Information

User information shall be handled in accordance with the separately established "aikoo Privacy Policy."

21. Terms Amendment

We may amend these Terms based on Article 548-4 of the Civil Code. Users who use the Service after changes are deemed to have agreed to the amendments.

22. Contact/Notification

Communications regarding the Service shall be made through forms on the aikoo site or methods specified by us.

23. Assignment of Contractual Status

Users may not assign, transfer, or pledge their status or rights/obligations under these Terms to third parties without prior written consent from us.

24. Governing Law and Dispute Resolution

These Terms are governed by Japanese law. However, if there are mandatory consumer protection provisions under the law of the user's residence, such provisions may also apply. In case of disputes, parties shall first attempt to resolve them through good-faith consultation.
